Examiner Interviews in Korea: the Underused Move That Rescues Rejected Applications

Most foreign applicants treat a Korean final rejection as a paper exercise: file a re-examination request with an amendment, hope for the best, escalate to appeal if it fails. That leaves Korea's most effective — and least used — prosecution tool on the table: talking to the examiner. In our internal statistics, it changes outcomes materially.

The three ways to get in front of a Korean examiner

  • Examiner interview (심사관 면담) — available throughout prosecution, including while responding to an Office Action. Conducted in person at the examination office, or by video/phone. Used well, it converts a written argument into a dialogue: you learn which of your positions the examiner actually finds persuasive before you commit to one on paper.
  • Amendment review (보정안 리뷰) — a KIPO program under which draft amendments are shown to the examiner for feedback before they are formally filed. This is the key feature for strategy: you can present multiple alternative claim amendments and learn the examiner's inclination on each — something no written procedure allows.
  • Re-examination interview (재심사 면담) — after a final rejection, Korea allows a re-examination (재심사): the same examiner reconsiders the case with an amendment, which must be requested within 3 months of the rejection. Pairing that re-examination with an interview or amendment review is where rejected cases most often turn around.

The number that matters: +21.2%

E-BIRD's internal statistics across our prosecution practice show that after a final rejection, cases handled through a re-examination interview or amendment review achieve a grant rate 21.2% higher than cases where a re-examination request is simply filed on paper. For a patent that genuinely matters to your business — the one covering your actual product, or the one an investor or licensee is asking about — that difference is the whole game.

Why it works

  • You test options instead of guessing. In an interview or amendment review you can put two or three alternative claim sets in front of the examiner and read which one they consider allowable — before formally choosing. On paper you get exactly one guess per round.
  • Technical differentiation lands better in person. Subtle distinctions over the cited art — the kind that get flattened in translated written arguments — can be walked through, drawn, and demonstrated.
  • Real-world context persuades. This is the part most filers miss: presenting the applicant's related technology and actual products around the invention — not as claim evidence, but as context showing what the invention really is and does — measurably helps the examiner see the contribution. Selecting what to show and how to frame it is a matter of experience.

What preparation actually takes

An interview only outperforms paper prosecution if you walk in with multiple prepared fallback positions and evidence for each: alternative amendment sets, mapped distinctions over each cited reference, and the product/technology materials mentioned above. An unprepared interview can anchor the examiner to a rejection just as easily as a prepared one can dissolve it. This preparation is an E-BIRD specialty — we run these interviews regularly and have a long record of post-rejection turnarounds built on it.

Cost

ItemAmount
Examiner interview / amendment review / re-examination interview — preparation & attendance (by scope of preparation)USD 600–1,500
Standard Office Action response (for comparison)USD 200–500 (hard cap 500)

The band reflects preparation depth: a focused single-issue interview sits at the lower end; a full post-rejection package — multiple amendment options, reference mapping, product/technology exhibits — at the upper end. We recommend the interview route selectively: for applications where registration genuinely matters, not as a default add-on.
