Fast-Track Patent Examination in Korea: Granted in Months, Not Years
By Min Seok Choi, Korean Patent Attorney · Managing Partner, E-BIRD IP · Updated August 2026
Korea is quietly one of the fastest major jurisdictions in which to get a patent granted — provided you use the expedited-examination system. This guide covers the current numbers, the government's 2026 acceleration drive, and — most usefully — the expedited-examination grounds that foreign applicants can actually qualify for.
2026: Korea's IP administration is racing to cut examination time
In its mid-2026 policy briefing, Korea's IP administration (MOIP — the Ministry-level successor to KIPO) announced a package of measures under the banner "changing the game of economic growth with IP." The parts that matter to filers:
- Examination backlog target: 14 months for patents (11.2 months for trademarks) by the end of 2026, through additional examiners and full-scale deployment of AI examination tools.
- Ultra-fast examination expanded for nationally important fields — first results within 1 month.
- Supporting ecosystem moves: overseas-patent support for 50 selected technologies, a ₩140bn IP monetization/transaction fund, IP finance expanded toward ₩13.3tn, an integrated IP search service covering patents/trademarks/copyright, and a substantially enlarged "technology police" unit (4 divisions / 61 investigators) focused on technology-leakage and trade-secret enforcement — a signal of how seriously Korea now polices IP.
Context for budgeting: on the normal route, examination currently begins on average about 18 months after the examination request (improving toward the 14-month target). The expedited route changes that picture completely.
Expedited (priority) examination: the numbers
| Route | Time to first examiner action |
| Normal examination queue | ≈ 18 months (target: 14 by end-2026) |
| Expedited examination | ≈ 2–5 months |
| Ultra-fast track (limited categories) | ≈ 1 month |
Per KIPO statistics (Dec 2023), expedited cases averaged about 6 months from filing to registration. In our own practice, a well-prepared expedited case can be granted roughly 4–5 months from the Korean filing date — a speed few major offices can match, and a genuine strategic weapon when you need an enforceable Korean right quickly (e.g., an infringer or a licensing negotiation).
Grounds foreign applicants can actually use
Many of the two dozen statutory grounds are tied to Korean government programs, but several are fully open to foreign applicants:
- ① "Working the invention" (or preparing to) — the most broadly usable ground. If the applicant is commercially practicing the invention, or concretely preparing to (manufacturing, sales, licensing into Korea), the application qualifies. The catch: you must file an evidence package (statement of working with supporting documentation) that satisfies the examiner — and what counts as sufficient is a matter of practical experience. This is an E-BIRD specialty: we prepare the working-statement and supporting materials for you, and we have a long track record of these being accepted. Result: examination typically taken up 2–3 months after the request, with grant possible in about 4–5 months from filing in fast cases.
- ② Fourth-industrial-revolution technology fields — applications classified in designated tech classes covering AI, IoT, 3D printing, autonomous vehicles, big data, cloud computing, intelligent robotics, smart city, VR/AR, innovative pharmaceuticals, renewable energy, personalized healthcare, drones, next-generation communications, intelligent semiconductors, advanced materials, blockchain, smart manufacturing and next-generation biopharmaceuticals. If your invention sits in these fields (most of our inbound work does), expedited examination is available essentially as of right.
- ③ PPH and office-to-office arrangements — where Korea has an agreement with your home office (US, JP, CN, EP and many others) and the earliest dates align, work-sharing-based expedited examination is available, typically leveraging your existing allowance or search results. See our PPH guide for the requirements and documents.
- ④ PCT cases where KIPO acted as ISA — international applications searched by the Korean office qualify directly.
- ⑤ Other targeted grounds — carbon-neutral/green technology, pollution-prevention technology, semiconductors and national strategic technologies (per periodic notices), and third-party infringement of a published application.
What it costs and how we handle it
Two cost components, both fixed and published like everything else we do:
| Item | Amount |
| Official fee — expedited-examination request | ₩200,000 (≈ USD 145), payable for every ground including PPH |
| Attorney fee — expedited-examination request (by ground/type) | USD 480–680 |
The band reflects the work involved: a classification-based request (e.g., a fourth-industrial-revolution technology field) sits at the lower end, while a "working the invention" evidence package — statement of working plus supporting documentation, prepared to examiner-accepted standard — sits at the upper end.
